Terms of Service

These Terms of Service govern your use of Pulse Studio, a studio management platform owned and operated by Stoked Global (Pty) Ltd, South Africa. By creating an account or using the platform you agree to these terms. If you are accepting on behalf of a studio or business, you confirm you are authorised to bind that business.
1. The service
Pulse Studio provides software for fitness studios to manage class schedules, bookings, memberships, payments, and member communication, including a web portal and a member mobile app.
We may improve, change, or discontinue features over time. Where a change materially reduces the service you pay for, we will give you reasonable notice.
2. Accounts and responsibilities
You must provide accurate information when registering and keep your login credentials secure. You are responsible for activity that happens under your account.
Studio owners are responsible for the content they publish through the platform (class descriptions, prices, emails to members) and for their own compliance with laws that apply to their business, including consumer protection and tax obligations.
3. Trials, subscriptions, and billing
New studios start on a free trial (14 days unless stated otherwise for your plan). No payment details are required during the trial.
After the trial, continued use requires an active subscription billed in South African Rand at the plan prices shown in your studio portal. Plan limits (members, classes, staff) apply as described on each plan.
You can upgrade, downgrade, or cancel at any time from your portal. Fees already paid are not refunded for partial billing periods unless required by law.
4. Member payments and payouts
Payments from your members are processed through third-party payment providers (such as PayFast), or recorded manually by you. You can either connect your own merchant account, so member payments settle directly with you, or use the Pulse Studio account, in which case we collect member payments on your behalf and pay them out to you.
Where we collect on your behalf, those funds belong to you. We hold them only until payout and remit them, less any fees agreed with you, on the agreed schedule. We may withhold or offset an amount where a refund, chargeback or reversal relates to a payment we collected for you.
Whichever route applies, Pulse Studio is not a party to the agreement between you and your members. You set your prices, class cancellation windows and refund terms, and you remain responsible for meeting them and for your obligations under consumer and tax law.
Chargebacks and payment disputes raised by a member are ultimately for your account, since the underlying service is yours.
5. Acceptable use
You may not use the platform to send spam, upload unlawful content, attempt to access other tenants’ data, disrupt the service, or reverse-engineer the software.
We may suspend accounts that breach these terms, with notice where reasonably possible.
6. Your data
Your studio and member data remains yours. We process it to provide the service, as described in our Privacy Policy. You can export your data or request deletion when you close your account.
7. Availability and liability
We aim for high availability but the service is provided “as is” and we do not guarantee uninterrupted operation. To the maximum extent permitted by South African law, our total liability for any claim relating to the service is limited to the subscription fees you paid in the three months before the event giving rise to the claim.
Nothing in these terms limits liability that cannot be limited by law.
8. Termination
You may stop using the service and cancel at any time. We may terminate or suspend access for material breach of these terms. On termination we will make your data available for export for a reasonable period before deletion.
9. Changes to these terms
We may update these terms from time to time. If a change is material we will notify studio owners by email or in the portal before it takes effect. Continued use after the effective date constitutes acceptance.
10. Governing law
These terms are governed by the laws of the Republic of South Africa, and disputes are subject to the jurisdiction of the South African courts.

Subscription prices are shown in South African Rand. Stoked Global (Pty) Ltd is not a registered VAT vendor, so no VAT is charged. Card payments are processed securely by PayFast; we never see or store your card details.
